1. Who we are
Crowned is operated by Central Standardised Services Ltd., a private limited company registered in the Republic of Cyprus ("Crowned", "we", "us"). Our registered office details and registration information are set out in our Legal Notice. If you have questions about Crowned or these Terms of Service, please contact support@crowned.net.
2. What Crowned is
Crowned lets creators publish a page listing one-time items and monthly subscriptions, each with a price set by the creator. Anyone who opens a creator's page can send the creator money for an item, once or monthly, by card, without creating an account on Crowned.
A payment on Crowned is money you choose to send to the creator; the item describes what your support is for. Nothing is sold or delivered to you through Crowned: Crowned provides the page and the checkout and collects the payment on the creator's behalf through our payment provider, Stripe; it sells nothing of its own and does not hold your money. Anything a creator chooses to do in return for a payment happens outside Crowned and is between you and the creator.
3. Agreeing to these Terms
By making a payment on Crowned, or by using the site, you agree to these Terms of Service, which incorporate our Refund & Cancellation Policy, Acceptable Use Policy, and Cookies Notice. Our Privacy Notice explains how personal data is handled.
By making a payment you confirm that you are at least 18 years old, that you are legally able to enter into a binding contract, and that you are using your own payment method or one you are authorised to use.
If you do not agree to these Terms, do not use Crowned or make payments through it.
4. Payments
All payments on Crowned are processed by Stripe. Prices are set by the creator and displayed in US dollars. Your card provider may apply its own currency conversion and fees.
In addition to the creator's price, Crowned charges a service fee. The service fee is shown as its own line at checkout before you pay. The total you authorise at checkout is the amount that will be charged.
Your record of a payment is the receipt issued through Stripe and the confirmation shown after payment. We recommend using an email address you can access, as it is also how you manage any subscription.
5. Subscriptions
When you start a monthly subscription, you agree that it renews automatically each month on the same day of the month it started, at the price shown at checkout, until it is cancelled. The renewal terms are disclosed at checkout before you subscribe.
You can cancel a subscription at any time from your subscription page, which is linked from the confirmation shown after payment and from every receipt and invoice. Cancellation takes effect at the end of the period already paid for, and no further payments are taken after that. The subscription remains active until the end of the paid period.
A creator may also end a subscription, with effect from the end of the period already paid for. If a creator's account closes or the creator can no longer be paid, active subscriptions end at the close of their paid period and you are not charged for any period after that.
If a renewal payment fails, the subscription enters a past-due state and payment may be retried in accordance with our payment provider's procedures before the subscription ends.
6. Refunds and the right of withdrawal
Refunds are handled in accordance with our Refund & Cancellation Policy and applicable law.
Consumer law in the EU, EEA and UK gives consumers a 14-day right to withdraw from distance contracts for goods, services and digital content. A payment on Crowned is none of these: it is money you choose to send to a creator, with nothing supplied to you in return through Crowned, and it is made when you confirm it at checkout. Where applicable law nonetheless gives you a right of withdrawal or a refund, it applies in full; nothing in these Terms limits statutory rights that cannot be waived.
7. Your payment goes to the creator
Each payment is made to the creator whose page you paid on. Crowned collects it on the creator's behalf, and a payment made through Crowned is received by that creator.
Crowned is not a party to anything between you and the creator, and is not responsible for the creator's page, descriptions or conduct, or for anything the creator says or does in return for a payment. If something is wrong with a payment, contact us at support@crowned.net and we will assist in accordance with our Refund & Cancellation Policy.
8. Content and conduct
Creator pages contain content published by creators. We do not endorse any creator or content and we are not responsible for it, though we act on violations in accordance with our Acceptable Use Policy. You can report content you believe is illegal or violates our policies as described in the Acceptable Use Policy.
When using Crowned you agree not to misuse the site, including by attempting to interfere with its operation, accessing it by automated means without permission, misusing the checkout, or using Crowned for any unlawful purpose.
9. Chargebacks
If you believe a charge is wrong or unauthorised, please contact us first so we can resolve it. You agree not to make unjustified chargeback requests. Where we determine a chargeback was made in bad faith, we may restrict future payments, in accordance with applicable law and card scheme rules.
10. Availability and changes to Crowned
We may change, suspend, or withdraw any part of Crowned at any time. We do not guarantee that Crowned or any creator page will always be available or uninterrupted.
11. Our liability
We provide Crowned with reasonable care and skill. To the extent permitted by applicable law, we are not liable for the acts or omissions of creators, for anything a creator does or does not do in return for a payment, for issues caused by your device, software, or internet connection, or for third-party services including payment processing and email delivery.
If you are a consumer, nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, and you retain all mandatory statutory rights of the country where you live. We are not liable for loss of profits, business, or opportunity, or for losses that were not reasonably foreseeable when you used Crowned.
12. Changes to these Terms
We may update these Terms from time to time. The current version is always available on Crowned. Where a change materially affects your rights, we will give notice by reasonable means, including by posting on Crowned and, for active subscriptions, by email where required and possible. Continued use of Crowned after a change takes effect constitutes acceptance of the updated Terms.
13. General
If any part of these Terms is found unenforceable, the rest remains in effect. If we do not enforce a provision, that is not a waiver. We may assign or transfer our rights and obligations under these Terms as necessary to operate Crowned. These Terms do not create any agency, partnership, or employment relationship between you and us.
14. Governing law and disputes
If you are a consumer, these Terms are governed by the laws of the Republic of Cyprus to the greatest extent permitted by the laws of the place where you live, and you may also rely on mandatory rules of the law of the country where you live. Consumers in the EU or EEA may generally bring claims in the courts of their country of residence or in Cyprus, as permitted by applicable law. UK consumers may bring claims in the courts of the United Kingdom or in Cyprus.
If you access Crowned from the United States, Section 15 applies to you.
You agree to notify us before bringing any claim and, where we request it, to attempt resolution in good faith before formal proceedings.
15. United States: arbitration and class waiver
This section applies to users located in, residing in, or accessing Crowned from the United States.
Any dispute arising out of or relating to these Terms or your use of Crowned will be resolved by binding individual arbitration administered by National Arbitration and Mediation (NAM) under its Comprehensive Dispute Resolution Rules and Procedures, rather than in court. The Federal Arbitration Act governs this section. Arbitration takes place in the US state in which you reside, or another location the parties agree.
Where 25 or more similar arbitration demands are filed with consistent or coordinated representation, they will be administered under NAM's Mass Filing Supplemental Dispute Resolution Rules and Procedures then in effect. If NAM is unavailable, the parties will select a comparable administrator, and if they cannot agree within 30 days, either party may ask a court solely to appoint a substitute so that arbitration may proceed.
You and Crowned each waive the right to a jury trial and the right to participate in class actions or representative proceedings, to the fullest extent permitted by law. Either party may bring an individual claim in small claims court instead of arbitration.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by written notice to legal@crowned.net.
If you are a consumer residing in the United States, our total liability to you for all claims arising out of or relating to these Terms is limited to USD 250 per claim, except where a higher amount is required by mandatory law.
